The Centers for Medicare & Medicaid Services (CMS) on March 19 announced details of its plan to implement a moratorium that temporarily prohibits a physician from referring patients to a specialty hospital in which he or she has an ownership or investment interest. Those specialty hospitals may also not bill Medicare or any other entity for services provided as a result of a prohibited referral, according to a CMS press release.

The moratorium was enacted by Congress as part the Medicare Prescription Drug Improvement and Modernization Act of 2003 and will expire June 8, 2005, according to CMS.

CMS released a program transmittal that included definitions and criteria governing patient referrals. CMS defined the types of services provided by speciality hospitals covered by the moratorium; a list of types of hospitals not subject to the moratorium, how to determine if a hospital is grandfathered under the provision, and information on seeking an advisory opinion. Go to http://www.cms.hhs.gov and look under "headlines" to read the press release.
