CMS releases guidance for specialty hospital moratorium

The Centers for Medicare & Medicaid Services (CMS) on March 19 announced details of its plan to implement a moratorium that temporarily prohibits a physician from referring patients to a specialty hospital in which he or she has an ownership or investment interest. Those specialty hospitals may also not bill Medicare or any other entity for services provided as a result of a prohibited referral, according to a CMS press release.
The moratorium was enacted by Congress as part the Medicare Prescription Drug Improvement and Modernization Act of 2003 and will expire
CMS released a program transmittal that included definitions and criteria governing patient referrals. CMS defined the types of services provided by speciality hospitals covered by the moratorium; a list of types of hospitals not subject to the moratorium, how to determine if a hospital is grandfathered under the provision, and information on seeking an advisory opinion.
