MA Supreme Court rules state medical board can access peer review information

The Massachusetts Board of Registration in Medicine can access confidential peer review information from hospitals during its investigations, according to a recent Massachusetts Supreme Court summary judgment.

The ruling came from a case in which the Massachusetts Board of Registration in Medicine requested information from a hospital during a review of a practitioner accused of “physician misconduct during a physical examination.” The hospital refused to turn over the information, including credentialing documents, citing confidential peer review laws.
