Ask the expert: Are CRNAs eligible for fair hearing rights?

Q: Your hospital board has decided that it is in the best interest of patient care to grant an exclusive contract to provide anesthesia services to General Anesthesia Associates. As a result of this contract, the current two anesthesiologists and three CRNAs will lost their privileges to provide services at the hospital. The anesthesiologists have already asked for a hearing under the medical staff bylaws to dispute their loss of privileges. The CRNAs were credentialed and privileged under the medical staff bylaws, just as the anesthesiologists were. Would the CRNAs also be eligible for fair hearing rights?

A: Yes, if the CRNAs were credentialed under the medical staff bylaws, they would be eligible to participate in the fair hearing and appeals process. However, note that this situation may have been avoided if, at the initial credentialingwhen they were initially credentialed, the delineated privileges contained a clause linking the privileges to a continuation of the contract.
