Medical Device Safety Act introduced in congress

Patients should be allowed to sue a medical device manufacturer if the company’s device injures them, according to a bill recently introduced in Congress. The proposed legislation comes on the heels of a U.S. Supreme Court decision last week that set a precedent for patients to sue drug companies whose products have caused them harm.

“Yesterday the Supreme Court rightfully upheld a patient’s right to legal recourse after sustaining an injury from a pharmaceutical product,” Rep. Frank Pallone Jr., a New Jersey Democrat, was quoted in The New York Times as saying. “Today, we introduce legislation that gives patients that same right when injured by a medical device.”
