Court rules hospital wrongly removed physician’s privileges

The Montana Supreme Court ruled that St. James Healthcare in Butte wrongly removed Jesse Cole, MD’s privileges, affirming the lower court’s decision. In the ruling, the justices noted that the organization’s bylaws acted as a contract between St. James and Cole. St. James’ actions, when it revoked Cole’s privileges, did not follow the bylaws and wrongfully broke the contract.

Additionally, the supreme court ruled that the lower court was right to issue an injunction to restore Cole’s privileges. “The court’s injunction protects both Dr. Cole’s patients and his professional reputation, at a minimal cost to St. James,” the ruling stated.
