OIG addresses pay for performance

Hospitals will not necessarily face fraud or kickback sanctions for sharing a private insurer’s pay for performance money with medical staff members, according to the Department of Health and Human Services Office of Inspector General (OIG). The OIG issued an advisory opinion to an organization requesting information and, on October 14, posted it on its Web site. However, the letter clearly states that the ruling is based on the specific facts presented and does not necessarily translate to other cases.
