Tip of the week: Clarify fair hearing processes in bylaw

The offer of a fair hearing following medical staff recommendation of corrective action is an important due process right that must be spelled out in bylaws or an associated hearing and appeal plan.

It is equally important that the bylaws clearly state whether the hearing procedures apply only to members of the medical staff or to all practitioners with privileges. Most hospitals articulate one hearing plan for physicians and another for AHPs and other clinicians who hold privileges but not medical staff membership. The hearing plan for these practitioners need not be elaborated in the medical staff bylaws.
