Ask the expert: Should your bylaws contain corrective action?

Bylaws should always contain language which addresses corrective actions, such as the following:
- The parameters describing the automatic suspension or summary suspension of a practitioner's medical staff membership or clinical privileges
- A description of when your organization will implement automatic suspension or summary suspension procedures
- A description of the mechanism your organization uses to recommend medical staff membership and/or terminations, suspensions, or reduction in privileges
Additionally, MSPs should continue to monitor Joint Commission (formerly JCAHO) standards to ensure that their organizations are meeting the intent of the standards. Legal counsel should always be consulted when these legal documents are revised or when standards that govern the documents change.
