CMS proposes extensive Stark changes
Healthcare Auditing Weekly, July 17, 2007
Earlier this month, CMS released a number of proposed and potentially far-reaching changes to the Stark regulations as part of its annual physician fee schedule update, reports Foley & Lardner, LLP, a nation-wide law firm.
The proposed Stark revisions would, among other things, prohibit certain "per click" leases and percentage compensation arrangements, eliminate many "under arrangements" joint ventures, and curtail use of the in-office ancillary services exception.
The long awaited Stark II, Phase III rules are not yet out, but are expected soon.
