Best practices for compliance with individual rights

Whether auditing and monitoring for all privacy rule rights is conducted as a combined activity or each is conducted seperately, the compliance activities should focus on two critical components:

  • Privacy rights are important to individuals, and they should be treated by the covered entity in a manner that reflects this. Adopt a positive attitude about personal privacy rights to reduce potential problems.

  • Heightened exercise of privacy rights may only be the natural result of distribution of the notice of privacy practices, or greater interest by all consumers for their privacy rights. But heightened exercise of privacy rights may be an indicator of other, systemic problems in the organization. If an individual feels compeled to seek access or offer an amendment to his or her personal health information (PHI), there could be concerns about quality of care or patient safety. A covered entity should not assume any cause and effect relationship without further investigation.
