When describing the Deficit Reduction Act (DRA), healthcare regulators aren't afraid to use the clearest and most direct language: "With these changes, you're either on the wave of change or under it," explained Brian Flood, Inspector General for the state of Texas, to an audience of compliance officers and auditors during the Health Care Compliance Association's Compliance Institute in Las Vegas in April. "There's going to be this complete change-a revolution in the industry-for Medicaid enforcement, and I don't think that point has been driven home."
"This is a slamdunk for enforcers," said Frank Sheeder, Esq., partner in the Dallas office of Brown McCarroll, LLP, regarding the DRA's requirement that providers educate employees and contractors on the False Claims Act. Sheeder also spoke during the Compliance Institute. "If [enforcers] come in and you don't have the required elements in place, your entire Medicaid reimbursement will be at risk."
