Q: What can we disclose to a friend or family member who is involved in the patient's care?
You can disclose PHI that is relevant to the friend's or relative's involvement in the patient's care. The patient may need to agree to such a disclosure, depending on whether he or she is present and competent.
This provision only allows disclosures directly related to a patient's current condition. Therefore, you should not disclose extensive information about the patient's medical history that is not relevant to the patient's current condition and that could prove embarrassing to the patient.
For more information see Section 164.510(b) Uses and Disclosures for Involvement in the Individual's Care.
