Justice Department, SEC, look more closely at Merck

Merck & Co. said the Securities and Exchange Commission (SEC) and the Justice Department are making inquiries into Vioxx, the painkiller that was recalled in late September, according to a November 9 Bloomberg News report.

The Justice Department demanded information about sales and marketing practices related to Vioxx in connection with a federal criminal healthcare investigation, Bloomberg reported, based on information from Merck in a recent SEC filing.

The SEC is also conducting an informal probe concerning Vioxx, Bloomberg reported.

The investigations come on top of the potential legal liability Merck faces in the more than 300 lawsuits that were filed by October 15 on behalf of patients claiming harm from Vioxx, Bloomberg reported.

The painkiller was found in a company-sponsored trial to double patients' risk of heart attacks and strokes after 18 months of use.
