Best practices for compliance with individual rights

Whether auditing and monitoring for all privacy rule rights is conducted separately or as a combined activity, the compliance activities should focus on two critical components:

  • Privacy rights are important to individuals, and they should be treated by the covered entity in a manner that reflects this importance. A positive attitude toward these rights and helping individuals exercise their rights may reduce the likelihood of an untoward event.

  • Heightened exercise of privacy rights may only be the natural result of distribution of the notice of privacy practices, or greater interest by all consumers for their privacy rights. But it may be an indicator of other systemic problems in the organization.
