Tips on how to avoid criminal liability

Your organization's reputation can suffer from allegations of witness tampering in an internal investigation. Avoid this risk at all costs. At the beginning of an investigation, give all investigation team members instructions on the following:

  • Federal obstruction of justice statute
  • Subornation of perjury statute
  • Applicability of these statutes to employee interviews

Let your team know that the law places limits on their interactions with potential witnesses.
