Suit against University of Chicago can proceed, says judge

An appeals court has reinstated six counts in a lawsuit against the University of Chicago and its hospital, according to an April 1 story in the Chicago Daily Law Bulletin.

The lawsuit was filed by the wife of Shawn Lenahan, a cancer patient who died during a cancer trial at the facility. According to the lawsuit, Lenahan was not properly informed about the risks of a cancer trial.

"Shawn Lenahan had signed a consent form that basically said the medications that would be utilized were safe and effective," said John Driscoll, the attorney for Lenahan's wife.

A judge had dismissed the 21-count malpractice suit earlier, but the appeals court said the university could potentially be held liable if the subject was not informed properly of the risks involved in the trial.
