Tenet will pay nearly $31 million to settle two cases

Tenet Healthcare Corp. agreed to pay nearly $31 million to settle one investigation involving a Tenet-owned hospital in Florida and a second nationwide probe, according to a March 25 Associated Press report.

Based in Santa Barbara, CA, Tenet said March 24 it agreed to settle a qui tam lawsuit brought seven years ago by a former employee of its North Ridge Medical Center in Fort Lauderdale, Fla.

Tenet said it will pay $22.5 million to settle charges related to physician employment contracts, coding practices, and the acquisition of certain medical practices.

The settlement is the largest False Claims Act recovery to date from a single hospital for alleged violations of the Stark Law. The employee, former executive Sal Barbera, could receive up to 25% of the financial recovery.

In the second case, Tenet agreed to pay $8.25 million to settle civil claims brought against the company regarding the payment of Medicare claims involving the transfer of patients from hospitals to other facilities.

The claims were part of a Justice Department probe of transfers made from Jan. 1, 1992, to Dec. 31, 2000.
