DME company owner, physician sentenced for Baton Rouge-area fraud scheme

Dahlia V. Kirkpatrick, MD, and Emmanuel M. Komandu, the owner and operator of Alpha Medical Solutions Inc., a medical equipment company, will serve 48 and 30 months in prison, respectively, for their roles in a durable medical equipment (DME) health care fraud scheme, according to a Department of Justice (DOJ) press release.
Kirkpatrick and Komandu each pleaded guilty to one count of conspiracy to commit healthcare fraud on October 4, 2010. From approximately January 2005 through February 2010, Komandu and Kirkpatrick submitted and caused the submission of approximately $775,000 in fraudulent claims to the Medicare program. The majority of the fraudulent claims were based on prescriptions for medically unnecessary DME, such as power wheelchairs, wheelchair accessories and feeding nutrients, which were written and provided by Kirkpatrick.
