Federal agencies seek input on anti-kickback statute and EMTALA rules

In two separate Federal Register issues, the Office of Inspector General (OIG) and CMS solicited feedback about the anti-kickback statute and EMTALA rules, respectively.
On December 23, CMS published a request for comments in the Federal Register regarding EMTALA's applicability to inpatients. The notice also reviews much of the legislative, administrative, and judicial history and development of EMTALA.
On December 28, the OIG published in the Federal Register its annual notice to solicit proposals and recommendations for developing new and modifying existing safe harbor provisions under the Federal anti-kickback statute.
