HIV clinic operator sentenced to 57 months in prison for Medicare fraud

U.S. District Judge Adalberto Jordan sentenced Jose Garcia, 55, to 57 months in prison for conspiracy to submit false claims to Medicare, pay healthcare kickbacks, and commit healthcare fraud, according to a Department of Justice (DOJ) press release.
Jordan also ordered Garcia to serve three years of supervised release and to pay, with his co-conspirators, restitution of $7. million.
According to the DOJ, Garcia operated Global Med-Care Corp. Inc., a medical clinic in Miami that purported to specialize in treating patients with HIV. From April through August 2003, Garcia and coconspirators used Global Med-Care to submit approximately $10.9 million in claims to the Medicare program for HIV infusion services that were never provided or were medically unnecessary.
