CMS issues Medicaid RAC proposed rule
On November 5, CMS posted a proposed rule regarding the RAC expansion into Medicaid. The rule provides guidance to states as they implement the new contingency-fee contractors. CMS is proposing that states fully implement their Medicaid RAC programs by April 1, 2011.

CMS posts OPPS final rule for 2011
On November 2, CMS posted the 2011 OPPS final rule for public inspection. Among other provisions, the rule contains further changes related to the physician supervision requirements under “incident to.”

On November 2, CMS posted the 2011 MPFS final rule for public inspection. Among other provisions, the rule contains changes related to physician signature requirements on lab requisitions.
