On April 30, a federal grand jury indicted Jeffrey McElveen and Robert Cleveland M.D. on charges of Medicare fraud, according to a Department of Justice (DOJ) release.

According to the DOJ, Cleveland certified that certain Medicare beneficiaries were eligible for power wheelchairs that were ordered from McElveen’s company, Positive Home Oxygen, L.L.C. In exchange for the certifications, McElveen allegedly agreed to refer patients to Cleveland’s practice. The DOJ estimates Positive Home Oxygen profited more than $800,000 from the scheme.
