On April 28 the Senate approved the Fraud Enforcement and Recovery Act of 2009, a bill designed to strengthen the government’s ability to recover fraudulent payments, according to a release issued by Senator Patrick Leahy (D-VT).
Leahy, co-author of the bill, said in a February 5 release that in addition to providing law enforcement agencies with the tools needed to root out fraud, the bill would extend the reach of the False Claims Act to include any false or fraudulent claim for government money or property, regardless of whether the:
- Claim is presented to a government official or employee
- Government has physical custody of the money
- Defendant specifically intended to defraud the government
