Anesthesiologist convicted of violating federal False Claims Act
Compliance Monitor, February 25, 2009
On February 19, a federal jury found Eugene Chen, M.D., a Las Vegas anesthesiologist, guilty of submitting more than 3,500 false claims to the federal government for consulting services he never provided, according to a Department of Justice press release.
According to the press release, the jury believed Chen submitted claims for consultation services that were either never requested or never performed and subsequently received approximately $421,000 from the Medicare program.
A hearing will be held to determine the amount Chen will be fined. Under the False Claims Act, violators are liable for up to three times the amount of damages suffered by the government, which in this case would be approximately $1.26 million.
