With the focus on enforcement increasing in many areas of healthcare compliance, auditors need to pay particular attention to trouble spots. Scrutiny from the OIG and the media has brought HIPAA security compliance to the forefront, making it important to reflect on your facility’s practices regarding this law.

On October 27, 2008, the OIG released a highly critical report of CMS’ HIPAA security rule enforcement. In the report, “Nationwide Review of the Centers for Medicare & Medicaid Services Health Insurance Portability and Accountability Act of 1996 Oversight,” the OIG stated that CMS has taken limited action enforcing the rule and investigated noncompliant covered entities only when there was a complaint.
