DOJ recovers billions in settlements, judgments in FY2008

On November 10, the U.S. Department of Justice (DOJ) announced it has recovered more than $1 billion in settlements and judgments form cases of fraud against the federal government.
 
The $1.34 billion returned to the government in fiscal year 2008 adds to the billions the government has recovered since Congress strengthened the civil False Claims Act in 1986, bringing the total to more than $21 billion, according to a press release from the DOJ.
 
The DOJ attributes $1.12 billion of the recoveries from healthcare fraud cases. The Department of Health and Human Services recovered a majority of that money in cases dealing with Medicare and Medicaid fraud. The largest recoveries came from pharmaceutical companies for allegations such as:
  • “Off label” marketing
  • Paying physicians, wholesalers, and pharmacies kickbacks to induce drug or device purchases
  • Knowingly failing to report the company’s true “best prices” for a drug to reduce rebates owed to the Medicaid program.
