New York hospital settles suit for $88 million, signs CIA

Healthcare Auditing Weekly, September 23, 2008

Staten Island University Hospital (SIUH) agreed to pay more than $88 million to settle claims of defrauding Medicare, Medicaid, and the military’s health insurance program, TRICARE.

According to a press release from the U.S. Department of Justice, of the total $88,916,448, $14,883,883 will go to the State of New York for damages to the state’s Medicaid program.

The settlement resolves a suit which alleged SIUH fraudulently billed Medicaid and Medicare for inpatient alcohol and substance abuse detoxification treatment, the press release states. A government investigation found that from July 1, 1994 to June 30, 2000, SIUH filed claims for treatment given to patients in beds for which SIUH had received no certificate of operation from the New York State Office of Alcoholism and Substance Abuse Services (OASAS).

In addition to operating 56 legit beds, SIUH administered treatment in 12 other beds in a separate, locked wing, concealed from the OASAS.

In addition to the settlement, SIUH agreed to a Corporate Integrity Agreement with the OIG.
