OIG issues policy statement regarding providers, practitioners, and suppliers that waive retroactive beneficiary cost-sharing amounts attributable to increased payment rates under the Medicare Improvement for Patients and Providers Act of 2008 (MIPPA).

On July 23, the OIG issued a policy statement regarding providers, practitioners, and suppliers that waive retroactive beneficiary cost-sharing amounts attributable to increased payment rates under MIPPA. In the policy statement, the OIG assured providers affected by retroactive increases in payment rates under MIPPA that they will not be subjected to OIG sanctions if they waive Retroactive Beneficiary Liability, subject to conditions noted in the policy statement. This is potentially relevant for hospitals because, among other things, the policy statement applies to changes in co-payments due to the changes made by MIPPA relating to Medicare payment for brachytherapy sources and therapeutic radiopharmaceuticals.
