Gift cards do not violate Anti-kickback Statute

Healthcare Auditing Weekly, July 29, 2008

The OIG determined providing gift cards for patients who were not satisfied with their hospital service expectations would not violate the Stark Law.

The unnamed health care system seeking the OIG’s advisory opinion is proposing they distribute $10 gift cards for local businesses to patients whose service expectations were not met. Service shortfalls include:
·        Excessive wait times
·        Cancelled appointments
·        Delayed meals
·        Excessive noise
·        Housekeeping or dietary concerns
·        Equipment problems
·        Loss of personal items

The health care system would prevent abuse of the program by tracking the issuance of gift cards to patients to ensure that patients do not receive more than $50 in gift cards in one year.
