The OIG released its Draft OIG Supplemental Compliance Program Guidance (CPG) for Nursing Facilities last week.
The new draft guidance supplements, but does not replace, the 2000 CPG for Nursing Facilities. The two documents should be used as a set of guidelines for developing and implementing a new compliance program or evaluating an existing one.
The draft guidance focuses on:
Compliance with fraud and abuse laws, including quality of care as it relates to failure of care liability under the False Claims Act and administrative sanctions
Submission of accurate claims
Kickbacks
Physician Self-Referrals
Anti-Supplementation
Medicare Part D
HIPAA Privacy and Security Rules
