It is hard to believe that we are already starting final rule season once again. However, last week CMS posted the display copy of the fiscal year (FY) 2009 Inpatient Prospective Payment System (IPPS) proposed rule on its Web site. CMS is proposing a number of several significant changes for FY 2009. These include:

Expansion of the list of hospital acquired conditions to include nine additional conditions in addition to the eight conditions currently on the list.

Expansion of the list of quality measures that must be reported in order to receive the full IPPS update to include 43 additional measures in addition to the 30 measures currently on the list.

Implementing changes designed to reduce avoidable readmissions.

Expansion of the post-acute transfer policy to treat as a transfer any case in which a beneficiary begins home health within seven days of hospital discharge (the current policy is three days).

Approval of four “new technologies” for additional payment under IPPS.

Changes to the EMTALA requirements.

Changes to the Stark law.
