OIG posts advisory opinion about patient assistance program

A specific program that arranges for drug donations to free clinics need not worry about Social Security Act penalties, according to an OIG advisory opinion.
The program, run by a non-profit corporation, obtains drugs from pharmaceutical manufacturer patient assistance programs to provide them to free clinics and federally qualified health centers that benefit financially-needy patients without outpatient prescription drug insurance coverage.
The OIG rendered its opinion based on the facts presented and expressed no opinion about any ancillary agreements or arrangements.
