The performance evaluation process-how thoroughly managers evaluate employees-can provide a good defense to retaliatory discharge claims. Managers must perform and document evaluations honestly, with a complete, accurate assessment of both good and bad attributes of the employee.

All too often, managers either gloss over deficiencies or simply rank poor performance as average to avoid the discomfort of difficult discussions or negative rankings. Managers who document only positive performance despite an employee's more negative attributes may make it difficult for the organization to later demonstrate that an adverse employment decision came after long-standing performance problems.
