Respiratory therapist sentenced for submitting false claims in Georgia

Healthcare Auditing Weekly, December 4, 2007

A respiratory thrapist in Georgia was sentenced to five years in prison, and will pay over $2.7 million in restitution for conspiring to commit health care fraud.

Michael L. Lawhorn falsely billed Georgia Medicare and Medicaid during his five year career with the Dodge County Hospital, billing for home oxygen services that were given to patients in Dodge County, GA and neighboring areas. Lawhorn allegedly conspired with other members of a durable medical equipment company to use false documents in his scheme. False blood test results were created in order to bill the government for unnecessary oxygen treatments for various patients.

U.S. Attorney Edmund A. Booth Jr., said the indictment against Lawhorn derived from a joint federal and state investigation into fraudulent billings for alleged home oxygen services to Georgia Medicare and Medicaid in Dodge Gounty, GA.
