EMTALA enforcement: What you need to know

Off-campus, provider-based hospital departments are not obligated to meet the final regulations under the Emergency Medical Treatment and Labor Act (EMTALA), unless they contain a dedicated emergency department (ED). This is perhaps the most significant modification to previous rules relating to EMTALA.
To comply, ensure that provider-based departments use the emergency medical service (EMS) system and maintain policies and procedures for appraisals and referrals of emergencies.
Dedicated EDs, according to the final regulation, include licensed EDs, entities that publicly state that they provide emergency services, and those for which at least one-third of its outpatient visits were for emergency treatment during the preceding calendar year.
