This week’s tip is an “Ask the Expert” with a question provided by a disease management facility in Irvine, CA. The answer is provided by Matt Boettcher, LCSW, the director of case management at St. Joseph's Hospital and Medical Center in Phoenix, AZ.

Q: As part of our hiring process, we have potential hires sit for four hours with staff on the floor. How do we overcome issues with HIPAA and payments when these interviewees are not yet on payroll?

A: One of the things we did early on when we wanted to do a “walk in the shoes” for potential new hires was to make sure it was OK with our compliance department and our HR department because of privacy issues associated with HIPAA. We discovered there actually is a one-page non-disclosure document that can be signed. This is the same form we use when students, consultants, and other observers come into the hospital. I think most hospitals either have a document, or, if you work with your compliance and HR department, will create one.

Because these interviewees are not yet hired, you should make it clear that they are not yet paid. It is part of the interview/hiring process. It is good for them to see if they want to work at our facility, and good for us to see if we want to hire them.
